Surfaced — Terms of Service

These terms govern your use of the Surfaced mobile application ("the App") provided by Forethought Studio ("we", "us").

1. Acceptance

By downloading or using the App, you agree to these terms. If you do not agree, do not use the App.

2. Description of service

Surfaced is a loyalty card wallet that stores your loyalty card barcodes and optionally uses your device's location to show you the most relevant card. The App offers both free and paid features.

3. Free trial and subscription

• New users receive a 30-day free trial with access to all features.
• After the trial, certain features (location-based card sorting, widgets) require a paid subscription.
• Subscriptions are available as monthly ($1/month) or annual ($10/year) plans.
• Subscriptions are billed through Apple App Store or Google Play Store. Their billing terms apply.
• You can cancel your subscription at any time through your device's subscription settings.
• We do not offer refunds directly; refund requests should be directed to Apple or Google.

4. Your data

Your loyalty card data (names, barcodes, colors) is stored locally on your device. We do not have access to your loyalty card data. You are responsible for backing up your data using the export feature.

5. Acceptable use

You agree not to:

• Reverse engineer, decompile, or disassemble the App
• Use the App for any unlawful purpose
• Attempt to circumvent the trial or subscription system
• Use automated systems to interact with our servers

6. Intellectual property

The App, its design, and its code are owned by Forethought Studio. Store names and logos displayed in the App belong to their respective owners and are used for identification purposes only.

7. Disclaimer

The App is provided "as is" without warranties of any kind. We do not guarantee that loyalty card barcodes will scan correctly at all retailers. We are not responsible for any loss related to loyalty card usage.

8. Limitation of liability

To the maximum extent permitted by law, Forethought Studio shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App.

9. Changes

We may update these terms. Continued use of the App after changes constitutes acceptance.

10. Governing law

These terms are governed by the laws of the jurisdiction where Forethought Studio is established.
